On November 26, 1979 appellant Eugene Jackson entered a voluntary plea of guilty to one count of an indictment charging him with possession of stolen mail in violation of 18 U.S.C. § 1708. He was sentenced to serve five years imprisonment, all but six months of which was suspended. The defendant was ordered placed on probation with a six-month period of confinement in a jail-type of institution. Thereafter, while on probation, he was charged with and convicted of a state offense. Jackson was thus in state custody when his parole officer commenced parole revocation proceedings against him. After a hearing on the probation violation charges, Jacksons probation was revoked and he was ordered to serve the remainder of the federal sentence which had been originally imposed upon him. That sentence, however, was ordered to run concurrent with a sentence of two to five years he had received upon the intervening state conviction.
